Subject:  Authorization of reimbursement for family caregivers in Medicaid home and community based waiver programs.

Summary/Major Elements:

• Current Medicaid law excludes from the definition of reimbursable medical services those services and supplies provided by any relative of the recipient.

• This act:

o Authorizes Medicaid to pay "family caregivers" providing care in the Medicaid home and community based waiver programs for persons with developmental disabilities or acquired brain injuries;

o Defines "family caregivers" and requires that they be certified by the Department of Health in the same manner as non-family caregivers and that they provide care through a corporation or limited liability company;

o Directs the Department to amend the state Medicaid plan and apply for a waiver from the Centers for Medicaid and Medicare Services, if necessary to implement this act.
