Catch Title:       Public works and contracts-2.

 

Subject:  Amending requirements to hire in-state contractors for public works and amending who is considered an in-state contractor.

 

Summary/Major Elements:

 

·        Amending the definition of "Resident" for the purposes of determining in-state contractor preference to include a corporation organized under the laws of any state, in existence for 2 years or more which has:

 

o       Continuously maintained a principal office in Wyoming for at least a year;

o       Employed 15 Wyoming residents for a year, and

o       Paid worker's compensation and unemployment taxes in Wyoming for a year; and

 

·        Requires that the Department of Employment make investigations to determine whether a person is eligible to receive or continue to hold a certificate of residency.

 

·        Places the burden of proof regarding the status of residency on the person whose residency is in question.

 

·        Provides a civil penalty for of $750 against a person who intentionally falsifies residency information.

 

·        Increases the total fine which may be imposed for the criminal penalty of failing to hire Wyoming laborers on public projects to $750 and provides that for a second offense, the person is barred from bidding on state public works contracts for one year.
