Summary/Major Elements:

 

       The act expands when a person is presumed to act in self defense by adding definitions to the current law.

 

       The law currently provides, in general, that a person is presumed to act in self defense when he uses deadly force against another who:

 

o       Illegally forces his way into the defender's home or habitation, or

 

o       Takes or attempts to take a person from the home or habitation.

 

       The act now defines:

 

o       "Habitation" as any structure designed for overnight accommodation, and

 

o       "Home" as an occupied residential dwelling place.
