Summary/Major Elements:

 

       Under current law, the Wyoming emergency response act provides a mechanism for government agencies to respond to various public emergencies, including emergency planning and responses to clandestine laboratory investigations.

 

       The act amends the definition of emergency response to include a clandestine laboratory investigation.  This act also amends the definition of emergency responder to include person involved in clandestine laboratory investigations.

 

       This act amends the membership of the state emergency response team to allow the inclusion of a person representing the aviation industry.

 

       Under current law an incident commander may declare a building, structure or land to be uninhabitable.  This act allows an incident commander to also declare a building, structure or land contaminated.

 

       Any property declared uninhabitable or contaminated may only be transferred or sold prior to remediation if a written disclosure is made to the prospective purchaser.  This act provides that receipt of that disclosure constitutes a full release of liability on the part of the seller and acceptance on the part of the buyer unless otherwise agreed to in writing.
