Subject:            Sale of nonplatted lands.

Summary/Major Elements:

● Current law prohibits the disposal, offer for sale or lease of any lots in any town or addition to any town or city until the lot is platted and the plat is recorded. 

● This act changes the prohibition to the sale of lots and defines "sale" as it is defined in the subdivision laws.

● Under current law failure to file a plat is punishable by a $50 fine.  This act deletes the $50 fine but provides that the prohibition is enforceable by all appropriate legal remedies including injunctive relief or writ of mandamus.
