Catch Title:       Ethanol producer tax credit.

Subject:  Limits the ethanol tax credit to certain ethanol producing facilities.

Summary/Major Elements:

● Current law grants an ethanol tax credit to an ethanol producer constructing a new ethanol plant after July 1, 2003.  Bill requires the plant to be constructed after July 1, 2003 and prior to July 1, 2011 to qualify for the credit.

● Current law also allows an ethanol producer to expand his production capacity after July 1, 2003 and still qualify for the tax credit.  Bill requires the plant expansion to be constructed after July 1, 2003 and before July 1, 2011.
