Subject:  Maximum value of improvements that can be constructed by a lessee on state lands and treatment of improvements. 

 

 

Summary/Major Elements:

 

       Currently a lessee of state land may construct or make improvements upon state land in an amount not to exceed two thousand dollars ($2,000.00) for each separate improvement, without obtaining permission from the director of the office of state lands.

 

       This act treats each improvement separately for purposes of determining the value of improvements.   

 

       In the event the improvement, as considered individually, is in excess of two thousand dollars ($2,000.00), the lessee may apply to the director for a special use permit and may request reimbursement. 

 

       If a lessee constructs or makes an improvement in excess of two thousand dollars ($2,000.00), as determined at the time of construction, without first obtaining permission from the director, the lessee may not obtain reimbursement and upon expiration of the lease the improvements become the property of the State.
