Chapter No.:       78

Prime Sponsor:     Joint Corporations, Elections and Political Subdivisions Interim Committee

Catch Title:       Counties-election districts.

Subject:       Modifying county election districts.

Summary/Major Elements:

·        Under current law counties may, via an election, be divided into 5 election districts where commissioners serve in single member districts.

·        This act allows such an election to divide a county into any number of districts with commissioners serving in single member districts, multi-member districts, at large or any combination thereof.  Whichever combination is used, districting must result in commissioners representing a population as nearly equal as is practicable considering the geographic, economic and social characteristics of the county.

·        This act also allows the county commissioners to pass a districting plan within those same parameters, but without an election, if required to do so pursuant to a final court order, or in response to changes in population affecting the constitutionality of a current districting plan.
