Subject:  Amends Wyoming's commercial driver's license statutes to satisfy the Federal Motor Carrier Safety Act.

 

Summary/Major Elements:

 

       The statutory amendments made in this bill are designed to bring Wyoming's motor vehicle statutes into compliance with the Federal Motor Carrier Safety Act;

 

       Previously, commercial drivers were eligible for deferred prosecutions under W.S. 7-13-301.  This bill makes commercial driver's ineligible for deferred prosecutions;

 

       Brings private school buses and contracted school buses into the definition of a "school bus;"

 

       Amends and corrects references to federal law;

 

       Requires more frequent confirmation of federal medical qualification certification;

 

       Specifies that driving under the influence convictions can disqualify a commercial driver from driving commercial vehicles;

 

       Increases penalties for violations of out of service orders;

 

       Clarifies that penalties apply to employers who knowingly allow, require, permit or authorize commercial drivers to violate commercial driver statutes or orders.
