Subject:  Affected landowner rights in the industrial siting process for wind energy facilities.

 

Summary/Major Elements: 

 

       This act allows "affected landowners" to take part in and receive notice of proceedings for permits before the Industrial Siting Council. 

 

       "Affected landowner" is defined to mean any person holding title to land on which a commercial facility generating electricity from wind is proposed to be constructed.  The definition includes any portion of any collector system located on those lands.

 

       This act requires that affected landowners be identified and that they be given copies of all applications and notice of all hearings and meetings.

 

       Pursuant to the act, affected landowners are asked to submit information and recommendations relative to the impact of proposed wind energy facilities and are given copies of all information received from commenting agencies.

 

       Agencies also must receive comments from affected landowners and submit a summary of all comments received.
