Catch Title:       Animal remedies.

 

Subject:  Creation of the “Animals Remedies Act” which addresses the oversight, production, labeling and marketing of animal remedies.

 

Summary/Major Elements:

 

       Outlines the process and procedure for the lawful use of Animal Remedies in Wyoming.  Animal remedies include any drug, combination of drug, proprietary medicine, biological product and combinations of drugs and other ingredients other than for food or cosmetic purposes, which is prepared or compounded for animal use, except as exempted by the director of the Department of Agriculture(“director”). 

 

       Requires registration of any animal remedies manufacturer (except the U.S. Dept. of Agriculture) prior to distribution in Wyoming.  Annual registration is required and is valid from the date of approval through Dec. 31 of each year.

 

       Requires certain standards be met in the labeling of such products, including but not limited to, a legible label that includes the name, address and trademark, if applicable, of the principal manufacturer or the person responsible for putting the product on the market, the common ingredients, directions for use and warnings. Also identifies the process and procedure for identifying misbranding of remedies.

 

       Requires professional supervision in making any animal remedy and allows the director access during normal business hours to any location where an animal remedy is made in Wyoming for inspection and sampling purposes.  Provides a process whereby the director or his agent can seize misbranded or otherwise unacceptable remedies.     

 

 

       The provisions of the Act do not apply to medicated feed, a registered and recognized pesticide, experimental or investigational animal remedy clearly labeled as such or a licensed veterinary acting within the scope of that license. 

 

       Outlines the prohibited actions in relation to animal remedies and provides that violation may result in a conviction of a misdemeanor with a fine of up to five hundred dollars ($500.00) and up to six (6) months in jail for the first offense and a fine up to one thousand dollars ($1,000.00) and up to a year in jail for any subsequent offense.  The act provides that any offense committed three (3) years after a previous conviction will be treated as a first offense for purposes of this provision.
