Summary/Major Elements:

 

       Creates a lifetime permit for municipal solid waste landfills.

 

       Requires operators of municipal solid waste landfills with a lifetime permit to submit a report to the Department of Environmental Quality (DEQ).

 

       Requires DEQ to annually inspect municipal solid waste landfills with a lifetime permit.  As a result of the inspection, DEQ may require adjusted operating practices at the landfill and may require an adjustment in the amount of the bond required.

 

       DEQ must establish a priority list of municipal solid waste landfills that need remediation.  The act provides criteria for establishing remediation priorities.

 

       Defines "orphan landfill sites" and allows the director of the DEQ to expend funds for remediation of orphan landfill sites.

       DEQ is required to submit a report to the joint minerals, business and economic development interim committee and the joint appropriations interim committee by December 31, 2012 concerning the remediation needs of orphan landfill sites within the state for the next year, the next biennium and the next ten years.
