Summary/Major Elements:

● This bill provides that any person who donates surplus emergency response equipment to any emergency responder shall not be liable for damages in any civil action or subject to prosecution in any criminal proceeding resulting from the nature, age, condition or packaging of the equipment;

● The bill provides an exception for grossly negligent, willful, wanton or reckless acts of a donor.

● The bill specifies that the governmental claims act will control in case of conflict with the bill's provisions.
