FISCAL NOTE

 

This bill repeals the authority of the Secretary of State, the State Auditor, the State Treasurer, and the State Superintendent of Public Instruction to employ their own legal counsel.

 

The bill also states that no funds appropriated for the 2013-14 biennium for the employment of legal counsel by these agencies shall be expended, and that all funding for these positions shall revert on July 1, 2012.

 

The Secretary of State, the State Treasurer, and the Superintendent of Public Instruction each currently employ one attorney on their staff, and each has included this postion in their 2013-14 budget request. The total amount of funding requested by these three agencies for these three legal counsel positions in the 2013-14 biennium is roughly $833,600 (General Fund).

 

The State Auditor does not currently employ their own legal counsel, and has not included a position for legal counsel in their 2013-14 budget request.

 

 

 

NOTICE-AGENCY ESTIMATE OF ADMINISTRATIVE IMPACT REQUESTED

 

This bill has administrative impact that appears to increase (or decrease) duties or responsibilities of one or more state agencies and may impact agency spending or staffing requirements. As introduced, the bill does not modify any state agency budget or current personnel authorizations.

The following state agencies will be asked to provide their estimate of the administrative fiscal impact prior to the first committee meeting held to consider the bill:
