Savings statute application to governmental claims.

12LSO-0021.C1

FISCAL NOTE

This bill provides that the one year extension of time to commence an action under the savings statute applies to actions and claims brought under the Wyoming Governmental Claims Act. This extension of time would only apply to acts giving rise to claims occurring on or after July 1, 2012.

The fiscal impact, in the form of potential increased expenditures by the State

Self Insurance Program from claims and attorneys fees, is indeterminable.

The State Self Insurance Program pays for claims filed against the state under the Wyoming Governmental Claims Act. It also reimburses the Attorney General's Office for costs associated with the litigation of claims filed, including outside council costs and expert witness costs. The increase in the time limit for a claim could result in the payment of claims and the reimbursemnt of legal costs that might not otherwise be incurred. However, this potental increase in expenditures cannot be determined.

The fiscal impact to the judicial system is indeterminable due to an unknown number of cases.
