Catch Title:       Exceeding speed limit while passing.

 

Subject:           Exceeding speed limits on two lane roads when passing.

 

 

Summary/Major Elements:

 

·         This act allows the driver of a passenger car, motorcycle or pickup not towing a vehicle to pass another vehicle and to exceed the speed limit by up to ten miles per hour while doing so under the following specified conditions:

 

·         The vehicle being passed must be traveling under the posted speed limit;

 

·         The passing vehicle must return to the right hand lane and posted speed limit as soon as practicable;

 

·         The posted speed limit must be at least 50 miles per hour;

 

·         All other motor vehicle laws apply;

 

·         The road must be a two lane road allowing travel in both directions.

 

·         If a driver exceeds the additional ten miles per hour he is subject to the penalty applicable to the full excess speed over the posted limit.

· Report Required – The department of transportation is required to report to the joint transportation, highways and military affairs interim committee by July 1, 2013.
