FISCAL NOTE

 

The fiscal impact in the form of donated funds through ATM transactions is indeterminable and the Department of State Parks and Cultural Resources is unable to estimate a projected revenue increase for the following reasons:

1.  The bill carries no mandate for banks or private providers of ATM machines to participate.  The bill makes bank participation voluntary and donations may or may not occur under this draft legislation;

2.  This is unique legislation – as far as the agency is aware, there is no precedent in other states that could provide a guide for accurately projecting increased revenue. Therefore, if the agency is successful in convincing one or more banks or private ATM provider to participate, it would be difficult to determine how many, if any, ATM users or the number of transactions which may make a donation.

 

As the legislation is currently written, the department interprets the bill as providing revenue for operations and maintenance with any donations revenue being deposited into an a separate account to be established as necessary when the bill takes effect.
