Summary/Major Elements:

 

ˇ        Existing law requires applications for use of water outside the state that will result in the transfer of 1,000 acre-feet or more of water to outside the state shall comply with additional application requirements and obtain legislative approval.

 

ˇ        This bill provides that although an individual use may be less than 1,000 acre-feet, if a collection of related applications or appropriations from the same source of supply for the same or similar use where the total use or transfer outside the state exceeds 1,000 acre-feet per year in aggregate, those applications can be aggregated to require compliance with the additional application requirements and legislative approval.

 

ˇ        This bill authorizes the state engineer to promulgate rules and regulations related to aggregating applications for use of water outside the state to determine if the total use exceeds 1,000 acre-feet of water per year.
