Subject:                     Limiting extraterritorial jurisdiction of municipalities.

 

 

Summary/Major Elements:

 

·        Under current law, the mayor of a municipality has jurisdiction as may be vested in him by ordinance:

 

·        Over all places within five miles of the corporate limits of the city for the enforcement of a health or quarantine ordinance and regulation thereof; and

 

·        In all matters excepting taxation within one-half (1/2) mile of the corporate limits of the city.

 

·        This act repeals the municipality’s authority over the area within five miles of the boundaries of the municipality.

 

·        This act authorizes a board of county commissioners to enact a resolution nullifying a municipality’s ordinance as to any unincorporated area within the 1/2 mile radius.
