Subject:                     Prohibits referral to a specific psychiatric residential treatment facility in a judges’ child placement order.

 

Summary/Major Elements:

 

·          Under the Medicaid program, if a child is placed in a specific psychiatric residential treatment facility (PRTF) by a judge’s order, the placement is presumed to be punitive, not medically necessary, and therefore, not reimbursable by Medicaid.  Placements made by a medical provider or multi-disciplinary treatment team are reimbursable by Medicaid.

 

·          This act provides that placement orders of children under the Child Protection Act, the Children in Need of Supervision Act and the Juvenile Justice Act shall not specify a particular psychiatric residential treatment facility (PRTF) or level of care.
