Subject:                     Duty of persons involved in vehicle accidents to make a report.

 

Summary/Major Elements:

 

·        Persons involved in vehicle accidents resulting in bodily injury or death, or property damage in excess of $1,000.00, currently are required to file an accident report with the Wyoming Department of Transportation.  The report included information about insurance coverage.  Responding law enforcement officers also are required to file an accident report containing information similar to that required of individuals.

 

·        Under Wyoming law, persons involved in a vehicle accident must provide proof of insurance.  An online verification system currently exists which allows the Wyoming Department of Transportation to verify whether a vehicle involved in an accident is covered by insurance, without the vehicle owner filing any accident report.

 

·        This legislation removes the obligation of individuals to file the accident report.

 

·        The legislation maintains the obligation of law enforcement officers to file accident reports.

 

·        The legislation establishes that a person has met his obligations to provide proof of insurance if a search of the online verification system reveals the existence of insurance.

 

·        The legislation makes conforming amendments to the Wyoming statutes to replace still relevant portions of laws that are repealed by the legislation.
