Catch Title:              Administrative control of acquired institutional lands.

 

Subject:                     Providing the state board of land commissioners with authority to manage certain acquired institutional lands.

 

Summary/Major Elements:

 

·        The Departments of Corrections, Family Services and Health have acquired institutional lands which are not being directly utilized by those departments.

 

·        This act provides that the board of land commissioners, subject to state and federal law and the conveyance document, shall manage the leasing, exchange, care and disposal of the acquired institutional lands not directly utilized for departmental purposes.

 

·        The board of land commissioners shall manage in consideration of the needs of the institution, alternative uses of the property which are compatible with the mission of the institution and limitations contained within the Wyoming Constitution, state and federal law and the conveyance document.

 

·        The board of land commissioners is to consult with local officials or governing body having regulatory authority over the acquired lands prior to authorizing the use or transfer of the lands to another agency or department of the state.

 

·        All funds from the sale of acquired institutional lands for which disposition is not otherwise provided for by state or federal law or the conveyance document, shall be deposited in the institutional land revenue fund.  Funds in the account shall only be appropriated by further action of the legislature and to support the major maintenance and capital construction for the institutions.

 

Comment:   Report required.  The director of the office of state lands and investments is to consult with the directors of the departments of corrections, health and family services and submit a report to the board of land commissioners and the joint agriculture, state and public lands and water resources interim committee identifying the lands subject to this act and potential best uses of those lands.
