Delete the Senate Standing Committee Amendment (SF0142SS001/A) entirely and further amend as follows:

Page 2-line 6 After "utility." delete balance of line and insert "The cost of a qualifying facility situated within Wyoming and greater than ten (10) megawatts in size shall not be included in rates and a utility shall not be required to enter into a transaction to purchase energy or capacity from such a facility unless the cost of energy or capacity or both of such transaction are determined by the commission to be less than or equal to the utility's avoided cost, considering the cost of energy or capacity from all other available generation sources. This subsection shall not be interpreted in a manner inconsistent with the requirements of applicable federal statutes and regulations.".
