Summary/Major Elements:

· The act modifies the requirements imposed for receipt of a grant or a loan under the municipal solid waste cease and transfer program.

· The act provides an exception to the requirement for an engineered containment system or performance based design standards for permitted facilities transferring waste for the purpose of closing the facility and allows an increase in the rate of waste accepted by a permitted facility, so long as it does not extend the life of or enlarge the facility.

· Exercise of the exception requires approval by the department of environmental quality and requires a time period for operation to be determined.

· Previously the law required all facilities to have an engineered containment system or performance-based design standards to receive a loan or a grant under the program.
