Summary/Major Elements:

· State payment of major maintenance for community college facilities has been set by various budget bill provisions in the past.

· This act uses the 2012 budget bill provision to establish in statute a process and parameters for state funding of community college major maintenance.

· The act requires the state building commission to adopt a funding formula for major maintenance on community college buildings.

· This act defines major maintenance as the repair or replacement of complete or major portions of building and facility systems at irregular intervals which is:

o Required to continue the use of the building at its original capacity and purpose; and

o Typically done by contractors due to personnel demand, time restraints or sophistication of work.

· This act specifies that student housing, student unions and auxiliary services areas funded exclusively through community college generated revenues shall be excluded from the funding formula.

· This act requires the community college commission to establish and maintain methodologies on a seven year phase-in period for major maintenance following the new construction of a community college facility.

· The act specifies that notwithstanding any provision of law enacted prior to January 1, 2014, the budget request for major maintenance funding for community college facilities will be calculated as provided in this act (thereby removing previous inconsistencies).
