Summary/Major Elements:

 

·        Under current law, if a canvassing board is unable to determine which candidate has been elected or nominated, the board must declare the election to be null and void and the clerk must call a special election.  The special election must be for the whole district even if the problem occurred in less than all of the precincts.

 

·        This bill allows a county clerk to declare only a portion of the results null and void and to limit the scope of the special election to the precincts affected.

 

·        The bill requires that all names on the original ballot be placed on the ballot for the special election.

 

·        The bill provides that only those persons registered in the precinct at the close of polls on the election day of the election declared null and void shall be permitted to vote in a special election.

 

·        The bill shortens the time period for holding a special election and lengthens the number of hours a polling place may be open for a special election.
