Summary/Major Elements:

 

·         The act creates a legislative taskforce to study digital information privacy.

 

·         The taskforce will consist of 4 legislators (2 senators, 2 representatives) and 3 members appointed by the governor.  The legislative service office will staff the taskforce and the University of Wyoming is charged with serving in an advisory capacity to provide technical and other relevant information requested by the taskforce.

 

·         The act requires the taskforce to hold 3 public meetings in 3 locations to receive information on the topic.  It also outlines a variety of issues to be considered, including ownership of the data, threat assessments and consideration of relevant judicial decisions and statutory provisions.  The act further establishes guiding principles in conducting the work, including that any data collection should be lawful and fair, relevant, necessary, accurate and up-to-date, with the purpose of collection specifically identified, with notification requirements, if possible.

 

·         The taskforce is required to initially report to a committee designated by management council by October 1, 2014, on board statewide policy level recommendations, with additional reports to be presented October 1, 2015 and October 1, 2016.

 

·         The act allows the committee designated by management council to develop legislation as appropriate in response to the report submitted by the taskforce.
