Summary/Major Elements:

 

·        This act provides funding for and creates a process for undertaking the construction phase of the state capitol building rehabilitation and restoration and Herschler building construction.

 

·        The process will be subject to an oversight group, comprised of the governor and eight members of the legislature.  The oversight group exists until 12/31/2019.

 

·        The act directs the oversight group to:

o   Determine space allocation in the state capitol to meet the needs of the legislature, the governor’s office, security, and if remaining space exists, the statewide elected officials.

o   Review and approve the department of administration and information’s final design plans for the state capitol, the Herschler building and the connection between the two buildings (which is to proceed as a single project).

 

·        The act directs the department of administration and information to:

o   Proceed with the design and construction of the project.

o   Design the Herschler building to accommodate offices for elected state officials for which insufficient space is provided within the capitol.

o   Provide alternatives to the oversight group for temporary location of elected officials and legislative functions during project construction.

o   Submit for approval to the oversight group any changes in the final design plan in excess of specified amounts.

o   Expend funds appropriated by the legislature for the state capitol and the Herschler building rehabilitation, restoration and renovation projects.

 

·        The act authorizes the department of administration and information an additional two time-limited, full-time positions.

 

·        The act grants the governor immediate direction and control of the execution of the project.

 

·        The act codifies and continues the advisory task force on capitol building rehabilitation and restoration until 12/31/2019.

 

·        The act directs the advisory task force to provide advice and recommendations to:

o   The oversight group regarding the final design and execution of the capitol building and Herschler building construction project.

o   The state building commission regarding a long range vision for future development of a capitol complex master plan.

 

·        The act authorizes the state treasurer and state auditor to utilize interfund loans from the permanent Wyoming mineral trust fund reserve account as necessary for the purposes of this act.  Provision is made for repayment of any loans with interest to the reserve account.

 

·        The act modifies various statutory provisions addressing office space in the capitol building by other appointed officials and entities.

 

Comments:

·        This act appropriates $259,000,000 from the capitol building rehabilitation and restoration account to the department of administration and information.

·        The act requires the governor to include an appropriation request of the lesser of $37,500,000 or the outstanding loan balance from the reserve account in each biennial budget request until the permanent Wyoming mineral trust fund reserve account loans are paid off.

·        Funds appropriated in this act do not revert until the project is completed.
