Tampering with food.

 1  AN ACT relating to crimes and offenses; establishing the

 2  crime of tampering with food; specifying elements of the

 3  crime; providing penalties; and providing for an effective

 4  date.

 5

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7

 8       Section 1.  W.S. 6-2-507 is created to read:

 9

10       6-2-507.  Tampering with food; penalty.

11

12       (a)  A person is guilty of tampering with food if in

13  the course of preparing, serving or otherwise providing food

14  or beverage in a public establishment he knowingly places

15  any bodily fluid or other severed body part in or on food or

16  beverage intended for human consumption.

 1       (b)  Tampering with food is a felony punishable by

 2  imprisonment for not more than two (2) years, a fine of not

 3  more than one thousand dollars ($1,000.00), or both.

 4

 5       (c)  As used in this section "public establishment"

 6  means an establishment selling or offering for sale, food or

 7  beverages to the public generally.

 8

 9      Section 2.  This act is effective immediately upon

10  completion of all acts necessary for a bill to become law

11  as provided by Article 4, Section 8 of the Wyoming

12  Constitution.
