    Tobacco prevention programs.

 1  AN ACT relating to administration of government; authorizing

 2  programs for the prevention and reduction of tobacco use as

 3  specified; requiring a report; and providing for an

 4  effective date.

 5

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7

 8       Section 1.  W.S. 9-2-121 is created to read:

 9

10       9-2-121.  Tobacco settlement funds; reduction of

11  tobacco use by minors; public awareness campaign; grant

12  program for youth groups.

14       (a)  The department of health shall develop and

15  implement a public awareness campaign designed to reduce

16  tobacco use by minors in this state.  The campaign may use

17  advertisements or similar media to provide education

18  information about tobacco use.

 2  (b)  The department may contract with a third party to

 3  develop and implement the public awareness campaign

 4  authorized by subsection (a) of this section.  Any contract

 5  awarded under this subsection shall be awarded on the basis

 6  of competitive bids.  Any request for proposal used during

 7  the competitive bid process shall include specific

 8  requirements relating to outcome-based evaluation of the

 9  contractor's performance.

11       (c)  The department of health shall develop and

12  implement a competitive grant program to support efforts to

13  reduce the use of tobacco products by minors in communities

14  in this state.  Grant recipients under this subsection may

15  include local governments, community-based organizations and

16  schools.  The department shall solicit proposals for grants

17  under this section by publication of a request for

18  proposals.  Any request for proposal used during the

19  competitive grant process shall include specific

20  requirements relating to outcome-based evaluation of the

21  grant recipient's performance.

23       (d)  The department of health shall also develop and

24  implement a competitive grant program to support youth

25  groups that include as a part of the group's program

 1  components related to the reduction of tobacco use by the

 2  group's members.  As used in this subsection, "youth group"

 3  means a nonprofit organization that:

 4

 5            (i)  Is chartered as a national or statewide

 6  organization;

 7

 8            (ii)  Has been in existence for not less than one

 9  (1) year;

10

11            (iii)  Has a membership of which at least sixty-

12  five percent (65%) is younger than twenty-two (22) years of

13  age; and

14

15            (iv)  Is organized and operated exclusively for

16  youth recreational or educational purposes and includes, as

17  part of the group's program, components relating to

18  prevention of drug abuse, character development, citizenship

19  training and physical and mental fitness.

21  (e)  The department shall report its activities under

22  this section including the authorized expenditures of any

23  money from the Wyoming tobacco settlement trust fund income

24  account created by W.S. 9-2-120 to the governor and the

25  legislature not later than January 15 of each year.

 2       Section 2.  This act is effective immediately upon

 3  completion of all acts necessary for a bill to become law

 4  as provided by Article 4, Section 8 of the Wyoming

 5  Constitution.
