Tobacco prevention programs.

A BILL
for
1 AN ACT relating to administration of government; authorizing
2 programs for the prevention and reduction of tobacco use as
3 specified; requiring a report; and providing for an
4 effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 9-2-121 is created to read:
9
10 9-2-121. Tobacco settlement funds; reduction of
11 tobacco use.

13 (a) Using a science and experience based approach, the
14 department of health shall develop and implement
15 comprehensive tobacco prevention, cessation and treatment
16 programs for Wyoming. During the initial years, the program
17 should be tailored to provide the most cost effective

1 reduction of tobacco related problems based on available
2 funds for each year.

4 (b) The department may contract with a third party to
5 develop and implement any part of the program authorized by
6 subsection (a) of this section. Any contract awarded under
7 this subsection shall be awarded on the basis of competitive
8 bids and shall include specific requirements relating to
9 outcome-based evaluation.

11 (c) The department may solicit proposals for grants
12 under this section by publication of a request for
13 proposals. Grant recipients under this section may include
14 local governments, community-based organizations, schools
15 and other organizations as appropriate. Any request for
16 proposal used during the competitive grant process shall
17 include specific requirements relating to outcome-based
18 evaluation of the grant recipient's performance.

20 (d) The department shall make every reasonable effort
21 to collaborate and coordinate with other entities of state
22 and local governments and other organizations to assure
23 maximum leveraging of resources, including people and money.
24 The department shall coordinate with those responsible for

1 controlling the abuse of alcohol and other substances,
2 juvenile delinquency and violence.

4 (e) The department shall give priority to the
5 following programs in regard to tobacco use in the state:
6
7 (i) Comprehensive community based programs;
8
9 (ii) Public education, including use of media
10 campaigns;
11
12 (iii) Youth involvement programs;
13
14 (iv) School and early childhood programs;
15
16 (v) Enforcement of laws related to access to
17 tobacco products by minors;
18
19 (vi) Programs to promote the cessation of tobacco
20 use;
21
22 (vii) Programs for the treatment of tobacco
23 related diseases.

1 (f) Any monies appropriated to the department under
2 subsection (f) of this section, after implementing
3 subsections (a) through (d) of this section, shall be used
4 to resolve other health issues of the people of the state of
5 Wyoming.

7 (g) Subject to appropriation by the legislature, the
8 department shall use funds from the trust fund income
9 account established under W.S. 9-2-120(b) to implement the
10 purposes of this section.

12 (h) The department shall adopt reasonable rules and
13 regulations in accordance with the Wyoming Administrative
14 Procedure Act to assure a long-range program to accomplish a
15 healthier citizenry.

17 (j) The department shall report its activities under
18 this section including the authorized expenditures of any
19 money from the Wyoming tobacco settlement trust fund income
20 account created by W.S. 9-2-120 to the governor and the
21 joint labor, health and social services interim committee
22 not later than October 1 of each year.

1 Section 2. This act is effective immediately upon
2 completion of all acts necessary for a bill to become law
3 as provided by Article 4, Section 8 of the Wyoming
4 Constitution.
