SUBJECT:                                       Chapter 13, Mental Health Division Bereavement Counseling.

 

NATURE OF RULES:                   Legislative and procedural.

 

STATUTORY AUTHORITY:        2006 Wyoming Session Laws, Chapter 40, Section 5.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.  Notice of  the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d).  No written comments have been received to date.

 

SUMMARY OF RULES:  These new rules have been adopted by the Department of Health, Mental Health Division, to comply with 2006 Wyoming Session Laws, Chapter 40, requiring establishment of procedures for payment of bereavement counseling services provided to surviving family members of emergency responders who die in the line of duty.   The rules provide definitions of bereavement counseling services and individuals who are eligible for payments of those services, as well as specifying procedures providers of those services shall follow to apply for reimbursement when eligible bereavement services have been provided.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the consent list and be approved by the Council as submitted by the Division.
