STATUTORY AUTHORITY:           W.S. 11-18-103(a)(v) and 11-32-102

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO: 

Apparently complete to date.

 

SUMMARY OF RULES: 

These rules are being promulgated to reflect the current citations in the federal rules and to make the rules consistent with other agency rules.  Other changes have been made to provide consistency between animal species that pose similar disease risks and to ensure better enforcement of the rules.  For more detail, refer to the agency's statement of reasons, however, it is noted that Section 17 references the old section number and the amended number is Section 20. 

 

In addition:

Section 8 – clarifies the duties of animal carriers, including importation requirements. 

 

Section 9 – is a new section for the duties of animal owners or owner's agents, including importation requirements.

 

Section 11 – is a new section for interstate equine (horse) health movement agreements.

 

Section 27 – is a new section covering the requirements for the importation of mustelids (weasel family). 

 

FINDINGS: 

The rules appear to be within the scope of statutory authority and legislative intent.  Compliance with federal law has not been determined as it is assumed the Attorney General has provided such review.
