STATUTORY AUTHORITY: W.S. 35-11-109(a)(i) and 35-11-302(a)(i)
DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION
SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date.
SUMMARY OF RULES: These rules are a substantial revision to the surface water quality standards. The changes to these rules are necessary to update the Wyoming surface water standards to comply with federal regulations and to carry out the responsibilities of the Agency in regards to the protection of surface water quality in Wyoming. For a comprehensive explanation of the changes in the various sections of these rules see the Agency statement of principal reasons.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
Compliance with federal law has not been determined as it is assumed the Attorney General has provided such review.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
