SUBJECT:                                       Chapter 2, Vaccination Against and Surveillance for Brucellosis.

 

NATURE OF RULES:                   Legislative, Procedural

 

STATUTORY AUTHORITY:        W.S. 11-18-103(a)(v)

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  These rules were reviewed previously by Management Council as emergency rules ER06-42 and ER07-01.  Generally, these rules are being promulgated to allow the Livestock Board to remove some of the federally imposed testing requirements on Wyoming livestock since Wyoming has regained Class Free Brucellosis Status and to leave certain testing requirements on a six (6) county area.  For more specific details, refer to the Agency's Statement of Reasons.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

Compliance with federal law has not been determined as it is assumed the Attorney General has provided such review.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
