DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Legislative, Procedural

SUMMARY OF RULES:  These rules are being promulgated to provide a formula for determining the bond amount required for storing grass seed.  The formula is five percent (5%) of a price per pound of seed using an annual Bureau of Land Management average times the total warehouse capacity. 

These rules were reviewed previously by Management Council as emergency rules ER07-12.

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
