STATUTORY AUTHORITY: W.S. 23-1-302(a)(i) and (viii)
DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:
SUMMARY OF RULES: Chapter 25 sets seasons, bag limits and regulations regarding falconry hunting. These rules are amended to clarify that each falconry capture license is valid for only one bird. The amendments also prohibit the take of peregrine and prairie falcons in a portion of Fremont County.
Chapter 56 regulates the issuance of lethal take permits. The amendments clarify that lethal take permits may be issued to protect wildlife from disease or hybridization in addition to previously specified reasons. The amendments add a reporting provision that requires permittees to report at the end of the year the number of each species taken under the permit. The amendments also clarify the penalties for violation of the chapter.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
