AGENCY:                                 Department of Education.

SUBJECT:                                 Chapter 33, Wyoming Bridges Summer School, Enrichment, and Extended Day Grant Program.

 

NATURE OF RULES:                     Legislative and Procedural.

 

STATUTORY AUTHORITY:         2006 Laws, Chapter 37, Section 3, as amended by 2007 Laws, Chapter 147, Section 2.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:

            The rules were not submitted in a strike and underline format as required by rules of the Secretary of State.  Otherwise, procedural compliance is apparently complete to date.

 

            The "notice of new rules" was not provided by LSO in a timely manner to the prime sponsor and standing committee which acted on the bill.  The notice has subsequently been provided; any comments received will be forwarded to the council.

 

SUMMARY OF RULES:

            The rules implement program changes enacted by 2007 Laws, Chapter 147, Section 2, whereby student enrichment instruction was incorporated into the summer school/extended day program funded outside of the education resource block grant model as a categorical grant program.  Additionally, required minimum hours of instruction for middle and high school programs were modified by the 2007 legislation.

 

FINDINGS:

            The rules appear to be within the intent and scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:

            That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
