SUBJECT:                                 Chapter 3, Section 8(e), Application for Permit to Drill or Deepen a Well (Form 1); and Chapter 4, Section 4(b), Workmanlike Operations.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO: 

Apparently complete to date.

 

Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28‑9‑103(d).  No comments have been received to date.

 

SUMMARY OF RULES: 

These new rules are being amended to comply with 2007 Wyo. Session Laws, Chapter 27 (HB 263) requiring operators to comply with the 2005 National Electrical Code. 

 

Chapter 3, new subsection 8(e) requires operators to certify that all electrical conductors outside of their facilities comply with the 2005 national electric code.

 

Chapter 4, new subsection 4(b) requires an operator to install and maintain all electrical equipment located in and around an oil and gas well in compliance with the 2005 national electrical code. 

 

The rules also require notice to be given prior to installation of the electrical work and require notice to the Agency when the electrical work is completed.

 

FINDINGS: 

The rules appear to be within the scope of statutory authority and legislative intent.

 

Compliance with federal law has not been determined as it is assumed the Attorney General has provided such review.

STAFF RECOMMENDATION: 

That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
