AGENCY: Public Service Commission.

DATE SUBMITTED: December 21, 2007.

SUBJECT: Chapter 3, Section 318, Non-Applicability of Several Commission Rules to Rural Electric Cooperatives that Become Exempt From Retail Rate Regulation Under W.S. 37-17-103, Docket No. 90000-99-XR-07 (Record No. 11311).

NATURE OF RULES:                     Procedural

STATUTORY AUTHORITY:         W.S. 37-17-101 through 105.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

SUMMARY OF RULES:       The rules are new rules clarifying that procedural rules related to electric utilities no longer apply to rural electric cooperatives that opt out pursuant to statute. 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.  A new rule letter was sent out on August 29, 2007.  No comments were received concerning the rules.

STAFF RECOMMENDATION:  That the rules be place on the Consent List and be approved by the Council as submitted by the Agency.
