SUBJECT:                                 Chapter VIII, Section 6, Wyoming Bred Horses.

 

NATURE OF RULES:                     Legislative, procedural.

 

STATUTORY AUTHORITY:         W.S. 11-25-104.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The rules being amended provide regulation for the conduct of horse races in Wyoming.  The definition of "Wyoming bred horse" is amended to specify that a Wyoming bred horse is a horse foaled from a Wyoming broodmare.  The rules are also amended to establish a definition of "Wyoming broodmare" which means a mare permanently domiciled in Wyoming except for certain purposes.  The rules as amended specify that the change will not affect the status of a horse bred prior to the 2007 breeding season.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the consent list and be approved by the Council as submitted by the Commission.
