SUBJECT:                                 Chapter 3, Black Bear Hunting Seasons.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 23-1-302(a)(i).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The rules set forth seasons and bag limits for black bear for the coming year.  The rules include minor amendments clarifying the when and how bait may be used in black bear hunting.  The rules also remove the option to notify the U.S. Fish and Wildlife Service instead of the Game and Fish Department upon the observation of grizzly bears using bait sites.  The rules open up various areas previously closed to black bear hunting but limit those areas to hunting without the use of bait.  One of the opened areas includes the previously designated grizzly bear recovery area.

 

FINDINGS:     The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:        That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
