NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 27-11-105(b).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:              Apparently complete to date.

 

SUMMARY OF RULES:        The Department of Employment's Workers' Safety Division administers the Wyoming Occupational Safety and Health Act.  The Division operates an Employer Voluntary Technical Assistance Program ("EVTAP") as part of its consultative and educational programs for employers.  This rule amends the Division's existing rule to provide that participation in EVTAP will no longer exempt an employer from regular safety compliance inspections.  The amendment also updates references to applicable federal regulations and terminology.

 

FINDINGS:     The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
