DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION
SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date. Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d). No comments have been received to date.
SUMMARY OF RULES: The Wyoming Board of Pharmacy administers the Wyoming Pharmacy Act. The Act was substantially revised by 2007 SF0061 (SEA88/Ch.211). These rule amendments implement those statutory changes and numerous other amendments. The Board's "Order Adopting Rules" provides an accurate and complete description of changes to its existing rules. Major changes include:
· Provision of additional definitions;
· Revision of information required of wholesale drug distributor applicants;
· Requirements for a wholesale drug distributor's designated representative;
· Additional specification of minimal requirements for the storage, handling, transport and shipment of presecription drugs;
· Pedigree requirements for drugs that leave the normal distribution channel;
· Revised handling and documentation requirements for returned, damaged and outdated prescription drugs;
· Implementation of continuing education requirements for phamacy technicians;
· Addition of the chicken pox vaccine Zoster to the list of immunizations which pharmacists are authorized to administer.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
