SUBJECT:                                         Chapter I, Certified Real Estate Appraiser Board and Chapter III, USPAP.

 

NATURE OF RULES:                        Legislative, procedural.

 

STATUTORY AUTHORITY:            W.S. 33-39-105

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:        Apparently complete to date.

 

SUMMARY OF RULES:  The rules being amended govern the certification of real estate appraisers.  The rules in Chapter I are amended by providing that permits and renewals of permits are for two years instead of three years at a cost of four hundred dollars instead of six hundred dollars.  The rules are also amended to specify that the course that applicants must complete must be at least fifteen hours.  The rules are amended to specify that examination scores more than twenty-four months old will not be accepted.

 

The rules related to the application process are amended by specifying that two appraisals from the appraisal log submitted by the applicant will be reviewed for compliance with the checklist adopted by the board.  The rules are also amended to require that applicants must submit fingerprint cards.  The amended rules would also require inactive permittees to submit proof that they have completed all continuing education requirements.  The continuing education requirements are amended to require thirty hours every two years including one Appraiser Qualification Board approved seven hour course.

 

The rules in Chapter III are amended to adopt the 2008-2009 edition of the Uniform Standards of Professional Appraisal Practice and to specify that the adoption does not include any later editions.  The rules are also amended to make technical corrections throughout.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and approved by the Council as submitted by the Agency.
