SUBJECT:                                 Chapter 26, Capital Improvement Projects-Countywide Consensus List Awards (Block Allocations); and Chapter 27, Emergency Capital Projects Grants-Individual Applications.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28‑9‑103(d).  No comments have been received to date.

 

SUMMARY OF RULES: 

Generally, these new rules explain distributions for capital improvement projects and emergency capital projects pursuant to 2008 Wyoming Session Laws, Chapter 48, Sections 328 and 329.  The rules define grant eligibility, application procedures, consent list procedures, evaluation criteria, board consideration, grant disbursement and administration, audits and inspections. 

 

More specifically:  Chapter 26 addresses ongoing grant administration and disbursements for capital improvement projects and countywide consensus list awards or block allocations.  Chapter 27 provides for emergency capital project grants and individual applications.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
