SUBJECT: Chapter 5, Wyoming Physician Recruitment Grant

NATURE OF RULES:                     Legislative and procedural.

STATUTORY AUTHORITY:         W.S. 35-1-1101.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:              Apparently complete to date.

SUMMARY OF RULES:          These rules implement a new Physician Recruitment Grant Program enacted by the 2008 Legislature (HB0155/HEA0062/Ch.121).  The program authorizes grants to hospitals, private physician practices and others seeking to recruit a physician, in consideration of the physician's agreement to serve specified populations within the recruiting community.  The rules:

· provide relevant definitions;

· specify responsibilities of the Department of Health, the recruiting entity and the recruited physician;

· provide procedures for selection of grantees by the department;

· identify grounds, procedures and repayment obligations upon breach of a grant agreement by a recruited physician.

FINDINGS:     The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
