SUBJECT:                                 Chapters 1 through 5, Wyoming Trauma Program.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:        

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:              Apparently complete to date.  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d).  No comments have been received to date.

 

SUMMARY OF RULES:        The 2008 Legislature reauthorized a program, administered by the Department of Health, for the partial payment to acute care hospitals and ambulance services for unreimbursed trauma care services (HB82 / HEA 52 / Ch. 105).  The Department of Health is also statutorily directed to develop a statewide emergency medical services and trauma care program.  These rule amendments implement the revisions to the reimbursement program and otherwise update the current rules, which were last amended in May, 2006.  The amendments:

 

            · Update definitions and terminology;

            · Provide for the designation of regional, area and community trauma facilities;

            · Add ambulance services to the list of entities eligible for trauma care reimbursements and revise the proration criteria for those reimbursements.

 

FINDINGS:     The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
