SUBJECT:                                         Chapter VI, Permittee Requirements;  Chapter VII, Licensing/Licensees; Chapter VIII, Conduct of Races; and Chapter X, Simulcasting.

STATUTORY AUTHORITY:            W.S. 11-25-104(e)

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The existing rules of the pari-mutuel commission dealing with permitees are amended to increase the fee for permitees from fifty dollars to one hundred dollars.  The rules of the commission dealing with licensees are amended to increase fees for certain licenses from thirty-five to fifty-five dollars, to increase fees for other licenses from fifteen to thirty-five dollars, and to increase the fee for a replacement license to ten dollars.  The rules are also amended to specify that a licensee has the option of obtaining a one year license or a three year license.

 

The rules related to the conduct of races are amended to specify that androgenic-anabolic steroids are not permitted except for certain thresholds for four specific steroids.  The rules related to the conduct of races are also amended to specify that double entries of the same ownership may be uncoupled for the purposes of wagering only for stakes races.  The rules for simulcasting are amended to increase the license fee for a simulcast facility from one hundred dollars to two hundred dollars.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the consent list and be approved by the Council as submitted by the Agency.
