SUBJECT:                                 Chapter 1, General Information; Chapter 2, Minimum Standards for Employment; Chapter 3, Certification; Chapter 4, Satisfaction of Minimum Training Requirements; Chapter 5, Minimum Standards for Instructors; Chapter 6, Review of Certification Decisions; and Chapter 7, Forms.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED  BY THE AGENCY TO LSO:  Apparently complete to date. After issuing its notice of intent to adopt rules, the agency received one comment.  The comment related to procedural issues and not directly to the proposed rule.  In response to the comment, the Board asked the Coroner's Association to draft a suggested procedures manual.

 

SUMMARY OF RULES:

 

The new rules change chapter numbering from roman to numerical characters.  They add abbreviations, outline standards for the retention of minutes and amend the requirements to complete a criminal law course if basic training at the Wyoming Law Enforcement Academy is not completed.   The new rules amend employment standards and minimum standards for certification.  They define advanced education as continuing education and outline when continuing training requirements must be met.  The rules also clarify the basic requirements which must be satisfied if a person is no longer certified or has been rejected for certification.  The rules adopt new standards for training and training requests, allow the prior approval of training, allow forms to be submitted upon completion of course work and allow video training, internet training and law enforcement teleconferencing.  The new rules delete the Board's authority to review certification decisions and replace the standards concerning the investigation of coroners' cases.  The rules attach the text of W.S. 7-4-104 and adopt the definitions contained therein.  Finally, they allow twenty (20) days to submit accreditation of inservice training requests. 

 

FINDINGS:   The rules appear to be within the scope of statutory authority and legislative intent.

 

 

 

 

STAFF RECOMMENDATION:  That  the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
